("lunarcresters", "we", "us", or "our"), including our website, fitness facilities, and related services, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and lunarcresters.

Membership terms, pricing, and class schedules are subject to change with reasonable notice. All members must complete appropriate registration forms and health questionnaires before participating in our services.

User Obligations and Conduct

By using our services, you agree to:

• Follow all facility rules and safety guidelines
• Respect other members, staff, and property
• Use equipment properly and responsibly
• Maintain appropriate hygiene and attire standards
• Arrive on time for scheduled sessions and classes

Prohibited conduct includes but is not limited to harassment, discrimination, unsafe behaviour, damage to property, and violation of our policies. We reserve the right to suspend or terminate memberships for violations of these Terms.

Health and Safety

Participation in fitness activities involves inherent risks. By using our services, you acknowledge and assume these risks. You represent that you are physically capable of participating in the activities and have no medical conditions that would prevent safe participation.

You agree to:

• Consult with a healthcare provider before beginning any fitness programme
• Inform us of any injuries, medical conditions, or physical limitations
• Follow all safety instructions and guidelines
• Use equipment only as instructed
• Stop exercising immediately if you feel unwell or experience discomfort

Payment Terms

Payment for services is due in advance according to the terms specified in your membership agreement or service contract. We accept various payment methods as advertised. Late payments may result in suspension of services and additional fees.

Refund policies are specific to each service type and will be clearly communicated at the time of purchase. Membership fees are generally non-refundable except as required by law or in exceptional circumstances at our discretion.

Cancellation and Termination

Membership cancellation policies vary by membership type and will be clearly explained in your membership agreement. Generally, cancellations require written notice and may be subject to minimum commitment periods or cancellation fees.

We reserve the right to terminate memberships immediately for:

• Violation of these Terms or facility policies
• Non-payment of fees
• Conduct that endangers others or disrupts services
• Fraudulent or illegal activity

Intellectual Property

All content on our website and in our materials, including text, graphics, logos, images, videos, and software, is the property of lunarcresters or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We may take photographs or videos during classes and events for marketing purposes. By participating, you consent to such recording and use unless you specifically opt out in writing.

Limitation of Liability

To the fullest extent permitted by law, lunarcresters, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

• Personal injury or property damage
• Loss of data or business interruption
• Failure to achieve fitness goals
• Equipment malfunction or facility issues
• Actions of other members or third parties

Our total liability to you for any claim shall not exceed the amount you paid for services in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you to the extent prohibited by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless lunarcresters, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of our services or facilities
• Your violation of these Terms
• Your violation of any rights of another party
• Your negligent or wrongful conduct

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable consumer protection laws.

Dispute Resolution

We encourage you to contact us directly to resolve any concerns. If a dispute cannot be resolved through direct communication, we may agree to participate in mediation or other alternative dispute resolution methods before pursuing formal legal proceedings.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website or otherwise communicated to members. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

For material changes that adversely affect your rights, we will provide reasonable advance notice and may offer you the opportunity to terminate your membership without penalty.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any specific membership agreements, constitute the entire agreement between you and lunarcresters regarding the use of our services and supersede all prior or contemporaneous communications and proposals.
